Share Andrew Oliver and the NCAA have come to a settlement in their lawsuit for $750,000. Oliver had sued the NCAA for the right to have representation in his MLB contract negotiations out of high school. The NCAA became aware of him using a lawyer and suspended him at the beginning of the 2008 NCAA Tournament. Oliver brought the case to court and got an injunction so he could play during the 2009 season. The case continued throughout the season including a judge saying that the NCAA violated the law by not allowing representation of the players.

Share If you have been following this site for over a year, then you have heard me talk about the Andrew Oliver case at least a few times. The main issue in the case is whether or not drafted players could use legal counsel to help them negotiate a contract. The NCAA has been very strict that these advisers violate the amateurism rule if they are paid like they were in the Oliver case. This is very interesting as MLB teams have lawyers helping negotiate contracts but the drafted player can’t? Don’t you think something is wrong there?

Share The NCAA is currently looking into cracking down on the Advisers/Agents in the MLB Draft negotiations. The reason for this comes from the Andrew Oliver case where he was deemed ineligible because he had an advisor (agent) representing him out of high school during his negotiations. MLB is also not happy with the current situation with how drafted players are receiving outrageous money from some of the large market clubs.

Share The Georgetown Athletic Department was placed on three years probation after an internal investigation discovered irregularities within the baseball program. The investigation focused on how 26 Georgetown student-athletes were members of a Work-Study program from the 2000-2001 to the 2006-2007 school years. Each of the student-athletes played for the baseball program while also working for the team doing various tasks, from laundry to trash pick-up or field preparations. The players were told by an assistant coach to fill out their time cards for blocks of time instead of the actual hours they worked. Of course, some of the time which the players were compensated for was never actually worked.

Share Oklahoma State is facing a meeting with the NCAA over a major rules violation a former player receiving a gift from an out of state congregation. The former player was not included in the documents but a hearing is scheduled on August 7th and 8th.
An OSU spokesman explained that the former player was on an out-of-state summer baseball roster in 2007, and during that summer attended a church. The player did not own a vehicle and had money problems, the spokesman said.
As anyone knows that has dealt with the NCAA, they do not look past these things that often so expect the Cowboys to face some sort of sanctions in the coming months.

Share I got an email today from Richard Johnson who is the attorney for Andrew Oliver in his case against the NCAA. He states in his email the the courts have dismissed the NCAA’s appeal of the declaratory judgment and permanent injunction against Andrew Oliver. The trial court on March 31st has set a trial date of October 19th to hear Andrew’s case against the NCAA for the remaining breach of contract and tortious interference with contract claims.
The interesting part of this email is the NCAA’s response to the injunction which was put into favor to let Andrew Oliver particpate in College Baseball. The NCAA states that the injuction has affected every single player in College Sports by having an agent represent them in negoations. You can check out the full PDF file by clicking here. Oklahoma State junior LHP Andrew Oliver won his case against the NCAA so he will be eligible for the 2009 season for the Cowboys. This is great news for Oklahoma State as Oliver is expected to be a first round pick and will be an excellent number 1 starter this season. Read the rest of this entry »

Share The Andrew Oliver case against the NCAA finished yesterday January 13th according to court records obtained by The College Baseball Blog. The judge ended up taking the case under advisement and ordered both parties to file findings of fact and conclusions of law by January 23rd. After that, he will deliberate the case and issue an opinion in a week or two. We should see a decision at the end of January or at the beginning of February. Read the rest of this entry »

Share The New York Times has put out an article today about the Andrew Oliver situation which ended up getting him suspended before the NCAA Tournament. He ended up getting suspended for his relationship with an agent after being drafted out of high school.

Andrew Oliver’s attorney says his client will be there when State starts classes next week. The real question is, will Oliver return to the mound for the Cowboys?
Until late spring, Oliver was OSU’s pitching ace, a sophomore left-hander capable of carrying the Cowboys to the College World Series. In the last two years, Oliver had become such a hot prospect that Scott Boras, one of the most powerful agents in baseball, wanted him as a client.

Share Darren Heitner of Sports Agent Blog continues his great work on the Andrew Oliver situation that exploded over the weekend.
